1. Acceptance of Terms
By accessing or using AiVizWiz (“the Service”), operated by Studio w230 — Simone Leonelli of New South Wales, Australia(“we”, “us”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. By using AiVizWiz you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.
3. Description of Service
AiVizWiz is an AI-powered creative studio for generating, editing, enhancing, rotating, and animating images and video. The Service uses third-party AI models and APIs to produce content based on your prompts and uploaded material.
4. Account & Access
- Access is granted via Google OAuth or a passphrase at our discretion.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- We may suspend or terminate access where reasonably necessary — including for breach of these Terms, suspected fraud, or legal or security reasons. Where practicable we will give notice.
5. Credits, Payments & Refunds
- Certain features consume credits. Credits can be purchased through the Service via our payment processor, Stripe. Prices are shown at checkout and may be exclusive of GST, VAT, or other taxes, which will be added where applicable.
- Credits are digital content supplied for immediate use. By purchasing, you ask us to make credits available to you straight away and acknowledge that, where a statutory cooling-off or withdrawal right would otherwise apply to digital content, it ends once supply begins.
- If a render fails for technical reasons on our side, the credits for that render are automatically returned to your wallet.
- Outside of automatic failure refunds, purchased credits are generally non-refundable — except where you are entitled to a remedy under applicable consumer law(see “Your Consumer Rights” below). If you believe a charge is incorrect or the Service was not as described, contact us and we will work with you in good faith.
- Credit balances have no cash value and cannot be transferred or redeemed for cash.
- We may change credit pricing and consumption rates going forward; changes do not affect credits you have already purchased.
6. Acceptable Use
You agree not to use the Service to:
- Generate illegal, harmful, defamatory, or obscene content.
- Infringe on intellectual property or privacy rights of others.
- Create deepfakes, or sexual, misleading, or non-consensual imagery of real, identifiable people.
- Generate content involving minors that is sexual or exploitative.
- Attempt to reverse-engineer, exploit, or attack the Service.
- Use automated tools to scrape or overload the Service.
- Circumvent access controls, rate limits, or security measures.
Serious or repeated violation of these rules may result in suspension or termination of your account.
7. Your Content & Uploads
You keep ownership of the prompts and original images you provide (“Your Content”). You grant us a limited licence to process Your Content through our third-party AI providers solely to deliver the Service to you.
You represent and warrant that, for everything you upload:
- you own it or have the necessary rights and permissions to use it; and
- you have the consent of any identifiable person depicted (or their guardian) to upload and transform their likeness.
8. AI-Generated Content & Outputs
- Outputs are produced by third-party AI models. As between you and us, we make no ownership claim over your outputs, and — subject to the model providers’ terms and your compliance with these Terms — you may use outputs you generate for personal and commercial purposes.
- Your rights in outputs depend on the terms of the underlying model providers and their licensors. AI outputs may not be eligible for copyright protection in some jurisdictions, and may unintentionally resemble existing works. You are responsible for clearing your intended use.
- Transparency: content created or materially altered with AI may need to be disclosed as AI-generated under laws such as the EU AI Act. You are responsible for any such disclosure when you publish or distribute outputs.
- The AiVizWiz brand, UI design, and codebase remain the property of Studio w230 — Simone Leonelli.
9. Your Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other consumer protection law that cannot lawfully be excluded. Where such laws apply, our liability is limited (at our option) to re-supplying the service or refunding the amount paid, to the extent permitted.
10. Limitation of Liability
Subject to “Your Consumer Rights” above and to the fullest extent permitted by law, Studio w230 — Simone Leonelli shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
To the extent permitted by law, our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or AUD $50, whichever is greater.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Studio w230 — Simone Leonelli from any third-party claims, damages, losses, or expenses (including reasonable legal fees) arising out of Your Content, your use of outputs, or your breach of these Terms.
12. Service Availability
We aim to keep the Service running but do not guarantee uninterrupted or error-free operation. The Service may be modified, suspended, or discontinued. Nothing in this clause limits your non-excludable consumer rights.
13. Data & Privacy
Our handling of personal data — including prompts, uploads, generated outputs, and international transfers to our processors — is described in our Privacy Policy, which forms part of these Terms.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer resident elsewhere, you may also benefit from mandatory protections of the law of your country of residence.
15. Changes to These Terms
We may revise these Terms. For material changes we will update the “Last updated” date above and, where appropriate, give notice. Continued use after changes take effect constitutes acceptance.
